We may update the Policy from time to time, and we will notify you of changes by posting a new version of the Policy on our website. 1. Definitions and Interpretation
In this Policy, the following terms shall have the following meanings:
“Eduphoria,” “we,” or “us” means Eduphoria Incorporated, a Texas corporation, who provides the platform through which the Service is delivered.
“Account” means collectively the personal information, educational information, possible payment information, and credentials used by Users to access Material and/or any communications System on the Website.
“Institution” is defined as: a school, district, college, university or other education institution or education agency, whether public or private, that adopts or uses the Service.
“You”, or “Your” refers to an Eduphoria User (defined below) of the Service in the event that an individual Eduphoria license is used or the Institution (e.g. School or District), as context may require. In the event that you’re entering into this Policy as a representative of an Institution, then the Institution agrees that it will take all reasonable steps to ensure that its authorized users adhere to this Policy.
“Cookie” means a small text file placed on your computer by Eduphoria when you visit certain parts of this Website and other Eduphoria Services. This allows us to identify recurring visitors and to analyse their browsing habits within the Website.
“Data” means collectively all information that you submit to the Website. This includes, but is not limited to, Account details and information submitted using any of our Websites, Services, or Systems.
“Service” means collectively the Eduphoria online facilities and applications, mobile applications, printed materials, online documentation, supporting software, Eduphoria website, and information Eduphoria makes available through the Website either now or in the future, or any other websites that link to this Policy.
“System” means any online communications infrastructure that Eduphoria makes available through the Website, either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities, and email links.
“Eduphoria User” means a single, named, person of legal age who can enter into a contract in the state or country in which the User resides and in no case, is under the age of 18, and who is an instructor or school administrator who has an end-user account to use the Service and is not a student.
“Institutional User” is an Eduphoria User whose account is managed by an Institution.
“Student Users” means those Eduphoria users who participate in the participant portion of the Service by entering a code provided by the Educator User and accessing the lesson or assessment materials or only obtain access to a Student Account (available only to Institutions) if the administrator on that account enables the ability to do so within the Service.
"Website" means the website that you are currently using (eduphoria.com, eduphoria.net, or schoolobjects.com), any sub-domains of this site (e.g. subdomain.schoolobjects.com), and other related Services unless expressly excluded by their own terms and conditions.
“Student Data” includes any data, provided by an Institution or its users, students, or students’ parents/guardians, that is descriptive of the student including, but not limited to, information in the student’s educational record or email, first and last name, birthdate, home or other physical address, telephone number, email address, or other information allowing physical or online contact, discipline records, videos, test results, special education data, juvenile dependency records, grades, evaluations, criminal records, medical records, health records, social security numbers, biometric information, disabilities, socioeconomic information, individual purchasing behavior or preferences, food purchases, political affiliations, religious information, text messages, documents, student identifiers, search activity, photos, voice recordings, geolocation information, parents’ names, or any other information or identification number that would provide information about a specific student. Student Data includes Metadata. Student Data further includes “Personally Identifiable Information (PII),” as defined in 34 C.F.R. § 99.3 and as defined under any applicable state law. Student Data shall constitute Education Records for the purposes of this Policy, and for the purposes of federal, state, and local laws and regulations. Student Data shall not constitute any information that has been anonymized or De-Identified, or anonymous usage data regarding a student’s use of the Service. Student Data includes Confidential Student Educational Records as defined by Family Educational Rights and Privacy Act (“FERPA”), 20 U.S.C.A. 1232g and accompanying regulations.
Information We Collect
When you access or use this Website or other Services, we may collect two types of information: (1) personally identifiable information; and (2) information that is not personally identifiable. Personally identifiable information includes information that identifies you personally, alone or in combination with other information available to us. Examples of personally identifiable information may include an individual’s name, address, telephone number, email address, job title or role, financial information such as credit/debit card numbers, and school or district information.
Your institution may provide some personally identifiable information to facilitate the creation of your account for you. This information is treated the same as information provided directly by you, and follows all of the same guidelines and terms outlined here.
As part of the standard operation of the Website and other Services, you may submit personally identifiable information. For example, when you create an account, you may provide personally identifiable information. In addition, should you attempt to communicate with Eduphoria via this Website, email, phone, or other Service, you may provide us with personally identifiable information, and we may keep your message, email address, contact information, and other personally identifiable information. At your option, you may provide additional personally identifiable information about yourself. When you visit the Website, however, you are not required to create an account with the Website or provide any personally identifiable information.

Do Not Track
Certain browsers have settings that allow you to turn on a “Do Not Track” (“DNT”) feature. If we become aware that a child under 13 has provided us with personally identifiable information, we take commercially reasonable steps to remove such information and terminate the child’s account.
Any personally identifiable information for any child or student must be provided by your institution to facilitate the creation of their Student User accounts and to analyze the resulting data. Eduphoria does not rent, sell, or share any child's personally identifiable information to other companies.
Student data may be shared with third parties to facilitate analysis, scoring, and other potential functions when necessary. We will not share personally identifiable information with third parties unless absolutely necessary to fulfill the function required. Student data is never rented or sold to third parties. Student data is only ever shared with third parties at the express consent of the Institution. Eduphoria will not use Student Data to train AI models not owned or managed by Eduphoria.
Cookies
Like many websites, we may use “cookies” to collect information. A cookie is a small data file that we transfer to your computer’s storage device for record-keeping purposes. We use cookies for two purposes: First, we utilize persistent cookies to save your login information for future logins to the Website. Second, we utilize session ID cookies to enable certain features of the Website, to better understand how you interact with the Website and to monitor aggregate usage by users and web traffic routing on the Website. If you desire to delete your account, please go to your account and follow the instructions to delete that account.
EU Individuals have the right to access their personal information. Upon request, Eduphoria will grant individuals access to personal information that it holds about them provided there is no information about third parties. In such cases, Eduphoria will redact such third party information.
Security
Your personally identifiable information will generally be stored in databases maintained by Eduphoria or our service providers. These databases are stored on servers located in the United States. Eduphoria may use third-party storage or service-provider companies to store your personally identifiable information, some of which may be outside of the United States.

Vendor does not sell Google user data to third parties, and will only use Google user data for the purposes of providing the Services to you. Vendor does not transfer Google user data to third parties for reasons other than providing or improving the Services.
